GENERAL POINTS

CHARIB Management of Condominiums, Ltd (from now on referred to as the franchisor or CHARIB) is a Portuguese company and subject to Portuguese law in all its national or international legal business.

 

WEBSITE

The present CHARIB site respects all the current norms in European Union and Portuguese legislation.

 

PERSONAL DATABASES

The franchisor states and guarantees that all the personal details collected by, submitted or communicated to CHARIB are kept and are subject to alteration or removal by clients in accordance with Portuguese law (the same applies to foreign clients). CHARIB databases are registered with the National Commission for Data Protection. NEWSLETTERS

Any visitor (whether a client or not of CHARIB®) can subscribe to CHARIB newsletters. The removal and alteration of details referring to the sending and receiving of newsletters are defined by the subscriber. All newsletters sent by CHARIB have the possibility of being cancelled by the subscriber.

 

FRANCHISING AND MASTER FRANCHISING

CHARIB® is a management, administration and maintenance of condominiums franchising chain. This means that each company that belongs to our franchising chain is legally and financially independent, while benefiting from the knowledge and experience in the management and maintenance of condominiums of the franchisor.

However, the companies in the franchising chain are independent, and the franchisor does not take any responsibility for the management of these companies.

In this way the franchisor is merely responsible, to its franchisees or master franchisees, for the training it gives, as well as making work material available (software, advertising, commercial and administrative methods). It is the responsibility of the franchisees to guarantee the good use of our working methods so as to give the complete satisfaction due to their clients.

Therefore the franchisor is not responsible for any actions or omissions made by its franchisees in relation to the condominiums administered by them. The responsibility for any acts or omissions is with the franchisee.

The relationship between master franchisee and its franchisee is subject to the law of the country they operate in.

PRESENTATION OF CONDOMINIUM ACCOUNTS

CHARIB® has the principle of clear, transparent and straightforward presentation of condominium accounts to the condominium owners. In fact, trust has not been “imposed” on us. We have achieved this by transparency. Therefore, CHARIB®, in the presentation of condominium accounts, gives the following documents to be analyzed: a list of all the condominium expenses, justification of the budget (this document compares the estimated budgets with the actual amounts spent), the accounts involving third parties (a list of all those who have worked for the condominium, the total amount of their services, amounts paid and any outstanding payments), the balance of the units (a list which indicates the amounts the condominium owners were asked to pay, amounts paid and any outstanding payments) and the analysis of the accounts. We also present a copy of the statement(s) of bank account(s) as confirmation that the condominium payments have been deposited in the condominium bank account(s).

As well as the presentation of the accounts specified above, CHARIB® gives condominium owners access by Internet to condominium accounts throughout the period of the contract.

 

 

MANAGEMENT REGULATIONS

In the working methods of CHARIB®, it is obligatory to open a bank account for each condominium for condominium fees to be deposited in, and for making payments for current and extraordinary management expenses. As well as this bank account, there will be another bank account for deposits to be made to the common reserve fund.

All cheques and payments concerning the condominium will go through these accounts and not the bank accounts of CHARIB® or any companies associated with it.

This also includes any payments made by Multibanco® (ATM) or home-banking (giving the name, reference, amount to pay) which are deposited in the condominium accounts and never in the account of the company which administers the condominium. The possibility of paying condominium fees by Multibanco® (ATM) is only available in shops/offices which belong to the CHARIB® franchising chain.

 

JURISDICTION

Any litigation arising from the existence or use of this website, will be dealt with only by Vila Nova de Gaia County Court in Portugal.
